Consumer information under Government Decree 45/2014. (II.26.)
Information on the Consumer’s right of withdrawal
Under Section 8:1. § (1) point 3 of the Hungarian Civil Code, only a natural person acting outside their profession, independent occupation, or business activity qualifies as a Consumer. Legal persons are therefore not entitled to the right of withdrawal without cause.
Under Section 20 of Government Decree 45/2014. (II.26.), the Consumer has the right to withdraw from the Contract without giving any reason within 14 days from the day of receiving the Product.
The Consumer may also exercise the right of withdrawal during the period between the conclusion of the Contract and receipt of the Product.
If the offer to conclude the Contract was made by the Consumer, the Consumer has the right to withdraw the offer before the conclusion of the Contract.
Withdrawal declaration
The Consumer may exercise the right of withdrawal by making a clear statement to that effect.
A withdrawal is deemed valid if the Consumer sends the declaration within the 14-day deadline.
The Seller confirms electronically the receipt and acknowledgment of the withdrawal declaration.
Obligations of the Seller in the event of withdrawal
Refund obligation
If the Consumer withdraws from the Contract under Section 22 of Government Decree 45/2014. (II.26.), the Seller shall refund the full amount paid by the Consumer within 14 days of becoming aware of the withdrawal.
Method of refund
The refund shall be made using the same payment method originally used by the Consumer, unless the Consumer expressly agrees to another method. The Consumer shall not bear any additional charges as a result.
The Seller is not liable for delays caused by an incorrectly provided bank account number or postal address.
Additional costs
If the Consumer chose a delivery method other than the least expensive standard delivery method offered, the Seller is not required to refund the additional cost arising therefrom. In such a case, the refund obligation only extends to the amount of the standard shipping fee indicated.
Right of retention
The Seller may withhold the refund until the Product has been returned or the Consumer has provided clear proof of having returned it.
Packages sent cash on delivery or with postage due will not be accepted.
Obligations of the Consumer in the event of withdrawal
Return of the Product
If the Consumer withdraws from the Contract, they must return the Product without undue delay, and no later than within 14 days from notifying the Seller of the withdrawal.
Costs of return
The direct cost of returning the Product shall be borne by the Consumer.
The Product must be returned to the Seller’s address. Packages sent cash on delivery or with postage due will not be accepted.
Liability for depreciation
The Consumer is liable for any diminished value resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the Product.
The Seller is only obliged to refund the full purchase price if the Product is returned undamaged, complete, and in its original packaging.
Cases where the right of withdrawal cannot be exercised
The Consumer may not exercise the right of withdrawal in the cases set out in Section 29(1) of Government Decree 45/2014. (II.26.), including in particular:
after the full performance of a service, if performance began with the Consumer’s express prior consent and acknowledgment that the right of withdrawal would be lost after full performance;
in respect of products or services whose price depends on fluctuations in the financial market beyond the Seller’s control;
for non-prefabricated products made on the Consumer’s instructions or at the Consumer’s express request, or products clearly personalized for the Consumer.
Statutory warranty
What rights does the Consumer have?
The Consumer may request repair or replacement of the Product, unless the chosen remedy is impossible or would result in disproportionate additional costs for the Seller.
Time limit for enforcing statutory warranty claims
The Consumer must notify the defect without undue delay after discovering it, but no later than within 2 months of discovery.
Statutory warranty claims may be enforced within 2 years from performance. After this limitation period, such rights can no longer be enforced.
Other conditions
Within 6 months from performance, the Consumer only needs to notify the defect and prove that the Product was supplied by the Seller. After 6 months, the Consumer must prove that the defect already existed at the time of performance.
Product warranty
In the event of a defect in the Product, the Consumer may choose to enforce either a statutory warranty claim or a product warranty claim.
Under a product warranty claim, the Consumer may only request repair or replacement of the defective Product.
A Product is considered defective if it does not meet the quality requirements in force at the time it was placed on the market, or if it does not have the characteristics described by the manufacturer.
A product warranty claim may be enforced within 2 years from the date the manufacturer placed the Product on the market.
The Consumer may enforce a product warranty claim only against the manufacturer or distributor and must prove the defect.
The manufacturer/distributor is exempt from liability if it proves, for example, that:
the defect could not have been recognized according to the state of science and technology at the time of placing the Product on the market,
the defect resulted from the application of legislation or a mandatory authority regulation,
the Product was not manufactured or marketed within the scope of its business activity.
The Consumer may not enforce statutory warranty and product warranty claims simultaneously for the same defect.
Warranty
In the event of defective performance, the Seller is subject to mandatory warranty obligations only in cases provided by Government Decree 151/2003. (IX.22.) on durable consumer goods.
Mandatory warranty applies to durable consumer goods such as technical products, machines, and tools if the purchase price exceeds 10.000 Ft.
For products not covered by the decree, the Seller does not provide a warranty.
Warranty claims may be enforced within the warranty period. The warranty period is 1 year and begins on the date the Product is delivered to the Consumer or, if installation is carried out by the Seller, on the date of installation.
For warranty matters beyond one year, please contact the manufacturer.
Replacement claim within 3 business days
For purchases made in the webshop, the Consumer is entitled to request replacement within 3 business days in the case of durable consumer goods covered by Government Decree 151/2003. (IX.22.). If the replacement claim is made within 3 business days, the Seller must consider the Product defective at the time of sale and replace it without further conditions.
Exemption from warranty obligation
The Seller is exempt from warranty liability only if it proves that the defect arose after performance.
The Consumer may not enforce statutory warranty and warranty claims, or product warranty and warranty claims, simultaneously for the same defect.
